RECENT CCB RULE CHANGES

A review of the most current CCB rules (dated April 1, 2006) shows the following recent changes:

Definition of Officer and RMI

: In order to be the RMI or an officer for a construction contractor, you must own more than 50% of the business. OAR 812-002-0533; 812-002-0537.

Clarification about “Past Unresolved Activity”

: In recent years, the CCB has increased its rules concerning what it defines as “past unresolved activity.” Generally, that means unpaid judgments or final orders against the company or against a different company with the same owners or officers as the current company. As of March 2006, the CCB has updated and clarified its primary rule on this issue, OAR 812-003-0175.

CCB Pre-Claim Notices

: The 2003 Legislature created a new rule that a party could not file a CCB claim without sending a written certified mail notice at least 30 days before filing the claim. Now, the CCB will waive this requirement if the claimant can show a letter from the respondent contractor that acknowledges receipt of the notice of intent to file a claim. OAR 812-004-0340(9).
